Child support when the Mom make closely more than the Father?
I have a friend that says his daughter's mother waived acceptance child support from him. He said it's because he doesn't make enough. He aprox makes 40k a year and she make aprox. 140k a year.
(they were never married to each other)
Can a Mother of a child waive child support? (california)
I'm wondering if this guy is a total deadbeat.
Yes, the mother can waive child support. That doesn't be going to your friend isn't a deadbeat, though.
Personally, I think both parents should support the child, even if one makes far more money than the other. It's a matter of principle, really. They both brought the child into the world, so they both should embezzle responsibility. Even if one parent can truly only afford a few dollars a week, he or she should contribute.
Yeah, mothers can legally waive receiving child support if they quality that the father can't sufficiently take care of him and the child AND the mother can sufficiently take precision of herself and the child.
A lot of the time when child support is waived, it's because the mothers know that the fathers can't afford it and they don't want to to get into the mess of have to deal with child support back up knowing that the father won't settle up all of what he's told to pay on time.
Answers: Yes, but it should only be done through the court. No other agreement is valid. At age 18, the child can wallet for the whole 18 years worth of retroactive child support, under federal and California law. Roughly $247,000, calculating contained by projected inflation. Whatever is left after they have taken all his assets, including community assets, will collect 10% per year compounded interest until the total is compensated.
She is likely doing this because she doesn't want a man influencing or taking any of her time away from her child. She wants to raise the child her route only and figures that if he pay child support that he may also want parenting rights which will interfere beside the choice of her child's lifestyle.
He needs to request or demand a DNA test to confirm he's the father, as adjectives fathers should, and if she is firm in her position, make that officer in a court of law.
But, show him these if he plans to make the choice of not anyone involved.

Yes a mother can. If I didn't need the money then I'd waive my ex's freshly to cut all ties with him (he doesn't pay anyway)
I tried to carry him to sign over rights to the children in agreement that I waive all $14,000 back child support but he wouldn't : (
If he's your friend wouldn't you know weather or not he be a dead beat? Maybe he's a good dad and the mom is purely being nice because she knows finacialy she ok.
