How to draw from a cutback within child support?
When we broke up she took me to court. My lawyer said there was no road that the judge was going to do shared custody even though the mother had mental problem and be an inpatient for two weeks during our breakup. The court then ordered me to pay 700 a month which I cant affordl. I was looking into ruin before she and I broke up so but was told it wouldnt help because most of my debt contained by not dissovable? Her aunt works in the child support collections office and they already filed on me after two months beside out giving me a chance to figure things out. During our breakup it was suggested to me by my supervisor that I put contained by my resignition because I was on my final warning so I did. I have however to find another full time job. So far I am working in between two part time job and am looking for a third. I need this 700 a month reduced to something more managable until I get on top again and dont know what to do. I have be giving her $200 a month so far but know I need to give her more than that. I get my babe-in-arms 11 to 12 days every month and she gets her the other 18-20 days a month so I take care of her a third of the time. I love her and want whats best for her and the best of things for her and her mother but she have to eat when she is by my house to and they are not making it financially possible for me. They did they support calculations assuming the mother has to engineer zero dollars and calculted it on a year when the company I was working for was severly understaffed and I worked lots of overtime ever month and nighttime shifts and weekend shifts. They also calculated previously taxes and deductions were taken out of my check so the number they used to calculate the sum was about 35% higher consequently the amount that I actually take home after deducting state,federal, medicare, fica, and what ever else the payroll department comes up beside. They also was taking out medical insurance and cafeteria food used for work. The courts also dont even care about how much it cost to verbs to work such as car insurance, car notes, and food for the daytime. How do they expect you to work if you cant afford to get there and back? This is adjectives to crazy and doesnt seem fair, I know thats my babys best interest isnt the court system running me into the ground until I cant do anything for her, ruining my credit until I cant get any loans, and losing my coupé and insurance because i cant afford to pay them. I know I have to eventually file for a money off but I am not sure they will give it to me any more because I put in my resigination rather than agree to them fire me. Everyone said I should have let them fire me and collect unemployment but I told them you dont procure unemployment if you get fired for showing up late or calling surrounded by sick. They then say well you should enjoy been on time and not called contained by sick. I say it was a very rugged time in my life, I was breaking up next to the mother of my child and a woman I loved more than life itself and didnt know what to do. They then say you should own filed for custody when she was in the psyhc ward, and I articulate I didnt because I couldnt do that to her I just couldnt do it because I still loved her. Then they say you are stupid and theres nothing you can do immediately. I need help, some advice, someone on my side to see that adjectives I want is a chance to be in my daughters life and a prospect to make things better for my daughter than they were in my enthusiasm. Once again running me into the ground I seriously do not believe is going to make that happen.

Answers: the whole "The decide wont give you joint" is untrue and you were ill advise. i would either get your current attorney or a new one to directory a motion for modification of child support based on the change in your finances and career. it can and prob will get lowered that way and its the best way to cover your backside instead of getting back bsupport nuilt up on you. also, you shoudl petition the court to modify your orders. ask for joint custody- which is NOT 50-50. if you want 50-50, it will purloin some time and effort and def money but you can get it if you can show the judge that its within your childs best interest to have just as much time with you. if this woman have a history of violence, mental probs, drugs, etc, then you need to do the best you can to document that and retain adjectives the certified copies of this infomraiton. (another thing your attorney shoudl help you with bc it will require business archives affidavits and possibly some subpoenas for her medical history)
point is: if you truly want your child and want to have just as much time and rights as she does, then you will hold to fight Source(s): sam eboat right now with my husband and his childs mother.

I agree with Shannon E my uncle be in a similar situation. and everything worked out as soon as he changed lawyers and said hey look this is my situation. They will most likely know how they can comfort you and try but you also have to make sure that you ask them look before I hire you to be my advocate i want to know what you plan on doing and make sure you trust and listen to me because it Sounds like you can get custody of the child. Thank you for self such a hard working father, your daughter will see that when she's older and appreciate that but you will have to store your daughter out of harm it doesn't sound like the mother is sounds to embezzle care of your daughter.
