How do grandparents prove parents to be unfit for custody?

Grandparents have threatened to take custody of our daughter... and now they want us to stir through with a paternity test. Would getting a paternity test done and established paternity construct it any easier for them to take us to court for custody? Also, my boyfriend smokes pot... and he recently got into a coupé accident and can't walk while he is healing so he can't work. Me instead, I am clean, I work 2 part time jobs, and I am attending college full time online. Is within any reason really for custody to be awarded to them and how do I prevent that from happening? What are some reasons custody get awarded to grandparents and how do they prove the parents are unfit? Thanks.

Answers:    I am assuming this is the dad's parents since they're asking for a paternity test. but yes, establishing that the child is their grandchild would pave the way for a custody bid. Your age with two kids is unequivocally a factor... drugs definitely another factor. It is REALLY hard to take a child away from a automatic parent (in most states) but drugs, illegal activity, neglect, misuse, hostile and dangerous living conditions would be some factors that would sway a judge. Most grandparents back up getting custody because children are abandoned, natural parents don't follow thru on any court mandated parenting plan that would increase the child's situation or (and this is a big one) the grandparents have so much money to throw into lawyers and dragging the process out that young parents aren't competent to afford a long, drawn out defense. This is what a lot of grandparents plan from the beginning, but if you are aware of it and plan it right (don't give them any ammunition, be sure to hire a attorney that won't play into your fears to bleed you dry while the grandparents are dragging this out, check into legal aid, educate yourself so you know what all the motions, etc.,mean) next when it drags on you won't be buried because you expected it. If he is smoking pot then I muse they can take away your kids. If you don't want that to happen you may need to win rid of your man. I can't say for certain though. I do know its worse if he deals though. This happen to my aunt, her husband was smoking pot and I'm not sure what else he did but she ended up divorcing him. But they did share custody as well. As long as your verbs and responsible it shouldn't be an issue for YOU yourself. As for him, that may be a different story.
