The courts have to find him unfit. At this point, unless something major is going on, you should be happy that your daughter have a wonderful step-dad as well as her father in her life. I'm sorry that you are upset next to the situation, it is hard to deal with sharing children next to someone. You really need to think about what is best for the child though.
Just because she is his, he DOES own rights to her. At least until the courts decide otherwise. He is paying child support, which is more than what a real "deadbeat" dad does. Cut him some slack. He may not be the father you want him to be, but you did agree on to have a kid with him. If things are really bad, the court will hold no problems taking his custody. If they are just bad for you, they will not.

Tell the court you want follicle conducting tests on him. Tell the court that he is doing drugs around your kid. If this is the case, he can have his rights terminated.
Until you take those steps, he does own rights, and you need to act fast because your kid is within peril over there.

Nothing you said in this question will convince the court that he is unfit. To be "unfit" you literally have to foul language or neglect the child and leaving her with his mother is not considered unfit.
The court will most promising deny the adoption.
Only way is to get the childs bio father to give up his rights.

of course he can adopt your daughter.. in my state (michigan)- you can adopt a child a short time ago because you get married. (as long as you share HALF custody- with the father).
