Questions almost adoption...?

can a "fiance" adopt a child with out the "blood father" signing off his rights? He does not have any contact next to our child..was paying $10 a month for child support until he lost his job..and moved out of the state we live in beside out informing/changing the courts/parenting & visitation plan...need help..fiance and i will be getting married in july of this year
You may need an attorney. We adopt a grandchild last year and both my daughter & her husband's parental rights had to be terminated before the court would even consider a final adoption.
You own to terminate rights first. If the father doesn't want to, there isn't much you can do.
You have to be married for a absolute amount of time before a step parent can adopt your child, assuming that the father has signed over his rights.
Answers:    The father must consent to terminate his parental rights, the adoption will not be allowed id he refuses to do so unless his parental rights are terminated for some other reason close to abandonment or unfitness.

In some states you will need to be married to your new spouse for a year beforehand they can adopt, but the laws in each state are different. Source(s): http://www.child-adoption-matters.com/st…
