My husband want's to adopt my son how do we travel in the order of my husband adoping my son?
hi i am kirsty i am 23 years old i have just get married and my husband want's yo adopt my son i don't now where my son's dad is he has not see him for the past four years how do we go about my husband adoping him becasuse he can not enjoy no kids and we want to adoped a little girl please can you help
My husband adopt my children from a previous marriage and first thing I want to tell you is that asking this on here you are going to procure a lot of answers that say it cannot be done unless the bio-father consents. That is NOT true, Every state has grounds that can be used to call off parental rights, these include non-payment of child support or not seeing the child for a certain amount of time (abandoment).
With that being said what you inevitability to do is contact a family attorney in your area and find out the exact law in your state. In my state we could not even start the adoption until my husband and I were married for at least one year. We also could not find the Bio-father and have to give the last known address for him and finished up having to have the courts assign a Warning Order Attorney to him (we had to pay envelope for this) but it was an attorney whose sole purpose was to try and find him so that he could be notified. The Warning Order Attorney have two months to make a report to the court and when they could not locate him, we were given our court date and the adoption was granted.
I don't think you can certainly go ahead with the adoption without the biological father Signature. I know when the child hits a certain age its their choice, from what i remember i was 18 when i got my mums husband to adopt me and it have nothing to do with my biological dad but i do remember i had to hit a lasting age.
I live in Australia and im reading a few things on this page about adopting short the fathers consent. My step father tried to do this with me and all we get was No No No. We had to have the father consent or wait till i hit 18. I had no nothing to do next to my biological father but he still wouldnt sign me over. The law would be different in every country but i know for a reality that in Australia you DO need the fathers consent.

Probably you will own to wait 6 months or so. That is the way it is here. Contact an attorney and he will schedule court for a audible range. A notice will be published in the paper of his closing known address and if he fails to respond it almost 'cut and dried.' There should be no problem doing it.
Answers: Yep a family attorney. Is the right start. You will want to contact the bio father's family and make an effort to contact him. As far as the little girl go. Check out adoptuskids.org.. they have a very helpful site to bring the process started. It sounds like you both have alot of love to share.
You own to post it in the newspaper that you are looking for him (absent father). The last particular location. I am not sure for how long. You have to show the Judge that you did everything possible to try and locate him.
tell you the truth you don't enjoy too adopt the son if the son knows that he is the father but if you want you can but trust me you don't ok but it ain't my choice if you got married it is actually hes son to
The first thing you need to do is get ahold of a kinfolk law attorney in your area. Some states own a minimum time you must be married and others do not. So you must first find out if you have been married long enough for your husband to adopt, or if it matter in your state.
The lawyer will take nurture of all of the paperwork. If you do not know where your sons biological father is, you will have to run an trailer in the paper of the town where you later knew him to live for 30 days letting him know your husband has petitioned to adopt his son.
However if he has not rewarded child support in over a year, in some states, you have own his rights terminated without his consent. This is something your lawyer will advise you more or less as well.
Once all the paperwork is done, your lawyer will win you a court date. Your husband will have to answer a couple of questions for the judge. I be asked did I realize that I was taking on every responsibility for my stepdaughter that I would take on for a child I gave birth to and that even if the wedding ceremony dissoplved, I would still be responsible for her. I was also asked how our marriage was.
Our total cost be $750 for the lawyer and $140 court filing fee. My daughters first mom signed her rights away, so we didn't enjoy that expense. If you have to run an ad, that will be an extra expense. Source(s): adopted my step daughter
