I think they can at that age. If they have a prefrence I think they can. I'd want to live near my dad too. But my parents have shared...

You should contact a family law attorney to see what your option are. In many states the judge will put very little counterweight on what the children want.

i think that if your kids are 12 and 9 they are pretty much smart enough to choose who they favor..but maybe you should negotiate beside the mother and say listen they say they want to live with me tolerate them have a chance to see if they like it..but you hold to make sure they like it so you can prove the mother wrong ;]
